Subject to the terms, conditions and limitations set forth, Screwgle warrants to the buyer each overhauled or remanufactured compressor to be free from defects in material and workmanship. Screwgle’s entire and exclusive obligation and liability, and buyers sole and exclusive remedy under this warranty is limited to the repair or replacement at Screwgle’s option, free of charge of any part proving defective during the duration of this express warranty period provided below.
The obligations of Screwgle under this warranty shall not include any transportation costs, labour costs, installation costs, or other costs or charges associated with the repair or replacement. This warranty shall not be valid or enforceable if the buyer is in default in making any contract payments to Screwgle or fulfilling any conditions of maintenance. The duration of this express warranty is as follows:
12 months from the date of initial operation.
This warranty does not cover failures caused in whole or in part by improper installation or maintenance; improper use or application; corrosion; normal deterioration; the use or replacement parts or lubricants which do not meet or exceed OEM specifications; or improper repair.
Warranty consideration; buyer must notify Screwgle at the earliest of the buyer’s discovery of the defect or the time at which the buyer should have discovered the defect; buyer must immediately return to Screwgle (freight prepaid) all defective parts.
THIS WARRANTY IS EXCLUSIVE AND IN LIEU OF ALL OTHER EXPRESSED OR IMPLIED WARRANTIES INCLUDING, WITHOUT LIMITATION, ANY WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE WHICH ARE HEREBY DISCLAIMED. THE OBLIGATION AND LIABILITY OF SCREWGLE UNDER THE EXPRESS WARRANTY STATED ABOVE SHALL NOT INCLUDE LIABILITY FOR LOSS OF USE, LOSS OF PROFITS, OR ANY OTHER DIRECT OR INDIRECT INCIDENTAL OR CONSEQUENTIAL DAMAGES CAUSED BY THE FAILURE OF ITS PRODUCT OR ANY DEFECT IN THAT PRODUCT OR DELAY IN REMEDYING THE SAME.
